«Capitalism in the CMI, anti-market capitalism ?”» Philippe Bouquillion The Cultural and Media Industries (CIM) are usually considered as ruled by the market laws since the financial flows, goods and services liberalizations. The public authorities and the regulation authorities recognize that major companies can abuse of the power and that the extension of the market laws can also be limited by the issues linked the cultural diversity. However it is alleged that these limits are exceptional. The aim of this communication is to demonstrate that anti-competitive strategies are not the exception but the rules. Tree reasons explain why the CMI are ruled in a anti-competitive way. The first ones are the valorization ways and the territorial identity and the political issues raised by the CMI. The second ones are the financialiation and the concentration. The third ones are the public and regulation policies. Most of these characteristics structured the CMI from a long time but they became more acute during the last few years. The distinction introduced by Fernand Braudel between free market economy and capitalism can explain the present developments of the CMI and their central importance in the world economy. This point of view may also be interesting in order to analysis the new relationship between the players, content providers and network operators, of the CMI, and especially the ones that are resulting from the digitalization and the development of new products. Actually the different players don’t have, for instance, the same market powers or the same abilities in rising funds in order to buy other companies or to develop new products. The transformations of the CMI occur in a strong anti-competitive context.
